A Claim of Lien is a legal document signifying that the lienor (i.e., the person who records the lien) is claiming that another person is indebted to them. In the context of the construction industry a claim of lien is a legal document containing a statement made under penalty of perjury that the lienor has, pursuant to a contract, worked on or provided materials for a property and has not been paid.
The lien is recorded in the official records for the county where the property is located and serves as notice to the world, including potential buyers or lenders, that debt associated with the property. If payment is not made, the lienor can take legal action to force a sale of the property to recover their money.
If the property has a mortgage, the mortgage lender usually has the first priority to be paid from the sale proceeds. This means the mortgage must be paid off before the lienor can collect anything. If there’s money left after the mortgage is paid, the lienor receives their share. If the property sale doesn’t produce enough funds to cover both the mortgage and the lien, the lienor may only receive partial payment for the lien. If the foreclosure proceeds are sufficient to pay off the mortgage but not the full amount of the lien, the lienor can pursue the property owner personally to recover the remaining balance (this is sometimes done through a deficiency judgment).
Let’s say ABC Roofing Co. installs a new roof on a homeowner’s property. The agreed-upon cost was $10,000, but the homeowner only pays $7,000, leaving $3,000 unpaid. Despite repeated requests, the homeowner refuses to pay the remaining balance. To protect its rights, ABC Roofing Co. files a Claim of Lien with the county where the property is located. This document includes details like the amount owed, the work performed, and the property’s legal description. Once the claim is filed, the homeowner cannot sell or refinance the property without addressing the lien. If the homeowner still refuses to pay, ABC Roofing Co. can sue to foreclose on the lien, forcing the property to be sold to cover the debt. By filing the claim of lien, ABC Roofing Co. secures a legal path to recover what they are owed and ensures their work doesn’t go unpaid.
